BILASPUR: Chhattisgarh State Legal Services Authority (CGSLSA), Bilaspur and Jail Department, Government of Chhattisgarh Raipur will launch a campaign “Unmukt” from August 1, 2021. It is for release of those eligible convicts, who fall within the eligibility criteria laid down in the state policies for premature release of convicts.
The campaign owes its origin as per the direction of the Supreme Court in SLP(Crl.) No. 529/2021 titled Sonadhar vs. State of Chhattisgarh, wherein, the Supreme court picked three states I.e. Chhattisgarh, Uttar Pradesh, and Bihar for launch of pilot project from August 1, Member secretary, Siddharth Aggarwal in an official communication said that Justice Prashant Kumar Mishra, Executive chairman, CGSLSA will be closely monitoring the entire campaign. The necessary directives have already been issued to all the District Judges/Chairman of DLSAs to renderall necessary support to the jail authorities.
Instructions have also been issued for timely decision of pending applications of convicts under sec 432(2), Cr.P.C. The campaign will pass through the four vital stages beginning from timely identification of eligible convicts, and ending with legal aid by CGSLSA to those whose release applications have been rejected. Member secretary, Siddharth Aggarwal, also added that the timeline laid down by apex court shall be duly adhered to and the pilot project in Chhattisgarh will really facilitate the much needed experience for implementing it in other states too.
In in 2019, Justice Prashant Mishra, has delivered judgement of Amarnath vs. State of Chhattisgarh, WPPIL No. 78/17, wherein, presiding Judges have been directed to decide the application for opinion of release of prisoners under sec 432(2), Cr.P.C within the period of 03 months with proper application of their mind.
